How long you have to file a personal injury claim after a crash, in your state, with the statute it comes from and the date it was last checked.

Deadline to file an injury claim

2 years

Statute

Fla. Stat. § 95.11(5)(a)

When the clock starts

The day the cause of action accrues, normally the day of the crash.

Watch out for

Florida shortened this. Negligence claims used to sit under the four-year bracket and now fall under the two-year one, so older guides and older advice are wrong. Separately, Florida PIP requires you to get initial treatment within 14 days of the crash or the benefit is lost — a much earlier deadline than the one to file.
